According to the Pentagon's statement, posted on social media, the investigation is based on a federal law that allows retired service members to be recalled to active duty. Senator Kelly, a former U.S. Navy fighter pilot and astronaut who retired as a captain, is now under scrutiny. The Pentagon suggests Kelly's statements in the video may have interfered with the “loyalty, morale, or good order and discipline of the armed forces.”
But here's where it gets controversial... The Pentagon's statement indicates that further actions could include a recall to active duty for court-martial proceedings or administrative measures. In the video, Kelly and other lawmakers, many of whom have military backgrounds, directly addressed troops, stating, “you can refuse illegal orders.” They emphasized the importance of upholding laws and the Constitution.
Defense Secretary Pete Hegseth noted that Kelly was the only lawmaker targeted for investigation because he is the only one who formally retired from the military, thus remaining under the Pentagon’s jurisdiction. Hegseth added that Kelly's conduct “brings discredit upon the armed forces.”
Adding fuel to the fire, former President Donald Trump weighed in, accusing the lawmakers of sedition, a charge that carries severe consequences. Chief Pentagon spokesman Sean Parnell also issued a statement, emphasizing that the military follows legal orders.
Senator Kelly, responding to the criticism on CBS' “Face the Nation,” acknowledged the gravity of Trump’s words, noting the increased threats against them. He also reiterated the troops' obligation to reject unlawful orders, a principle that is legally sound.
And this is the part most people miss... While commanders often have military lawyers to consult, rank-and-file troops rarely have the same resources. The legal precedent is clear: simply following orders, the so-called “Nuremberg defense,” does not absolve troops of responsibility.
Interestingly, the video's impact on the troops themselves seems to be limited. A former servicemember noted that the message may not even reach many troops because it was posted on Twitter, which is not the primary platform where they consume information.
